What Is Marijuana Expungement (Prop 207) in Arizona?

ARS §36-2862 — created by Prop 207 — allows expungement of convictions for:

  • Possession, consumption, or transportation of 2.5 ounces or less of marijuana (of which not more than 12.5 grams was concentrate).
  • Possession, transportation, cultivation, or processing of six or fewer marijuana plants at the petitioner's primary residence.
  • Possession, use, or transportation of paraphernalia related to the cultivation, manufacture, processing, or consumption of marijuana.

Penalties & Consequences

Once granted, an expungement order requires the court, DPS, and any arresting agency to clear the record of arrest, charge, adjudication, conviction, and sentence. You may then state that the arrest, charge, and conviction never happened — on job applications, license applications, and in most other contexts.

  • Draft and file the §36-2862 petition in the convicting court.
  • Track and respond to any State objection within the 30-day window.
  • Coordinate with DPS and arresting agencies to confirm record clearance.

Our Defense Strategies

Eligibility review

Not every marijuana charge qualifies — quantity, plant count, and concentrate weight all matter. We confirm before you spend a dollar.

Multi-jurisdiction petitions

If you have qualifying convictions in multiple Arizona counties, we file in each convicting court.

Post-grant verification

We confirm your DPS record is actually cleared after the order issues — agencies miss this step regularly.
